3. When we apply for H1B next year will they require some H4 stamped on my wifes passport ? We dont plan to go out of the country for a couple of years so we will not be doing any stamping (H4). Currently she has her H1B stamped.

Appreciate your help.

Not it is not required, you will get approved H4 petition, but you will have to provide existing H1, new H4 petition while applying for new H1 and corresponding I-94's

Hi Horscorp,

It is possible to transfer the H1 with validity to 30-Sep-2011 as long as the PERM is active. However, once approved, the PERM will "expire" if no I-140 is filed within 180 days, and eligibility for further one year extensions would end. Similarly, if the employer withdraws the PERM or if it is denied and no appeal is taken further extensions based on that PERM would not be granted.

Sadly fantastic as Photoshop is it's not vector based, so anything you export to Flash can end up looking weird and stretched.

Have you tried using Illustrator? It's very similar to Photoshop in the effects and tools that you have available, with the added advantage that is is vector based. So you can draw in Illustrator and then export it into a Flash movie.

The only thing I'd add to this is that sometimes it will throw up errors about .eps files (no idea why) and you have to export it as a .swf and import that into Flash. Either way though, this should solve the problem.

My company has filed an AOS application on July 02 2007 using an approved EB3 I-140 (PD = Sep 2001). Then in Dec 2007, they have filed a EB2 I-140 using an approved EB2 PERM to convert the pending AOS apllication to EB2, hoping to port the priority date of pending AOS application to EB2 Sep 2001. EB2 priority dates were retrogressed after the EB2 I-140 was filed.

I am thinking of switching the job now. I don't expect USCIS to process the EB-2 I-140 for next 6 months or so. Is it safe to switch jobs in this situation? I have portability right now, since 180 days have passed after the AOS application was filed with EB3 I-140. Does the EB2 I-140 adversely affect the AC21 after I join the new employer. What will happen to my pending AOS application, when USCIS processes the EB2 I-140 from my original employer, before or after I have used AC21 from the new employer.

Appreciate your feedbacks on this.

Guys,

I did 3 Years Diploma in Computer Science after 10+2(Non Medical) from India and I have about 16 years of experience in IT. I am thinking of using this education to complete my Bachelors here in US. I would like to know what would my education equate to US Education.

I need an Idea how many courses I would have to take to complete the Bachelors? Please share any tips that would help me take less number of courses.It's not easy with kids.

Get a labor attorney, send a letter of claim to the employer, and request action within 30 days. If no response and amount is under $5000 then go to small claims court, otherwise file a grievance with your state's labor department.

The amount is approx $7000 and after deductions it will be just under $5000...can anybody suggest some good lawyer and what will be the charges...anybody else faced same issue in past....

for my 8th Year extension I applied on 16th Nov.2007
and got approval notice on 28th Nov.2007 with 1 Yr extension.
Actually based on December bulletin my attorney asked for 3 yrs. but got 1 yr. as in Nov my PD is current.
Off-course on 30th my I485 is approved.


So there is no doubt your attorney is so wrong.......

We got "Approval Notice Sent" emails 6 days back. I received my EAD 3 days back but haven't received my wife's yet.

Has anyone filed for Replacement EAD? Do we need to wait 30 days from the date we received the approval email? How long does it take usually to receive a Replacement card?

Please share your experiences.

I used AP to enter US in June this year.The IO stamp on my I94 and the AP document says 'Paroled unitl Sept 2009'. Should i consider the validity of AP until this date?

However on the actual AP documents under the Parole paragraph mentions the following: 'The bearereeparted the United States temporarily and intends to return to the US to resume processing of the adjustment of status application.Presentation of the original of this document prior to Sept 27 2008 allows a Customs and Border Protection Inspector at a port-of-entry to parole the names bearer...........'

Can you please let me know, what is the validity of the AP incase one is already out of country and is planning to return to US?Would the date on I94 be considered?

Just a quick update for future readers incase they get in to a similar situation as mine. Upon finding out that "transportation letter" might be a possibility my wife approached the United States Embassy in New Delhi (Key here is Embassy) the reason I say that is TL's are issued from Dept of Homeland Security which is always based out of an Embassy outside the US and not consulates. One has the option of applying for this at a consulate but they turn around and send all the informtion to DHS (at the embassy). This just takes too much time. At the embassy it wasn't too much trouble or no convincing needed however just to get the process done and receive the paper work in hand it took a good 4 business days and persistance. Also once you receive a transportation letter it is recommended that you shoot for a non stop flight since the TL's are 2 copies in a sealed envelope (1 for the immigration from your departure destination and the other for your immigration at the port of entry) before issuing a TL the embassy will ask you for your port of entry since the TL is addressed to that port. Lastly they did not charge anything for this but upon reading some other old posts in some forums if you go to a consulate they charge $180 for this. Hope no one has to go through this but if you do above is a debrief of what to expect.

The current events starting from a rumor has caused frustration in our members. The news coming out of AILA got us into action and we are working on trying to prevent this visa bulletin disaster to happen for our members. Due to weekend, There are less opportunities to pursue but we are not taking this as an excuse and please know that IV is working this weekend and have been working ever since we heard about this news and are using all measures and contacts at the appropriate levels of government to help our members. At this time we do not have a conclusive outcome for our members as the efforts are continuing. The efforts are in full swing and will continue until the bulletin comes out. This topic may be a bit counterproductive to what we've set to achieve as IVians but I hope folks see this in a true light. I could have set the title 'Return to Homeland', in my case its Return to India, hence the title.

I have been here for the past 9 years and as days progressed, my heart is back home. I may be closer than I ever was to get a GC but it seems I am to a point where I really want to give a shot to R2I. Reasons are several and are probably alike to several of yours. Family, Support and the whole other 9 yards..

That said, finding jobs back home while you are here in US seem not the easiest. I have seen a few in Google/Microsoft but I suppose there are many more. I am looking to return to Hyderabad. The reason why I am posting this here to is to seek help. If you or your friends work for companies that are looking for experienced managers to R2I, I would appreciate if you could post it here or PM me.

I am looking to R2I early next year but if the right opportunity comes along, I cud do it sooner than that. Thanks.
